TERMS AND CONDITIONS FOR BOOKING AND PAYING FOR VISITS


 
§ 1. General regulations

  1. These rules set out the principles for the provision of services at the clinic, as well asd the scope and conditions for making and booking appointments in person, by telephone and via the website.

  2. Definitions:

    1. Price list – the price list of services, made available to the Patient on the Provider’s website or at the clinic,

    2. Patient – an individual who uses services provided electronically by the Service Provider,

    3. Rules and regulations – the Rules and Regulations for the provision of services at the clinic, made available free of charge both at the clinic and on the website www.osteopatja.pl in a form that allows its downloading, recording and printing so as to enable free reading of the provisions of the Rules and Regulations prior to their acceptance,

    4. website – the Provider's website used for making appointments and booking appointments, available at www.osteopatja.pl

    5. Service – the service performed by the Service Provider, which involves providing the Patient with the possibility of making and booking an appointment electronically,

  3. In order to use the Service, you must read the Terms and Conditions carefully and, if you order the service via the website, accept the terms and conditions by ticking the appropriate box. Failure to accept the terms and conditions of the Terms and Conditions prevents you from using the Service.

  4. Other services, i.e. appointments, take place in person at the Clinic, at the time and place indicated when booking the appointment. The terms and conditions of the other services are not covered by the Terms and Conditions.


§ 2. Manner of using the services provided and fees

  1. Reservation of appointments made by electronic means shall be made via the schedule on the Website under the "Sign Up" tab.

  2. Reservation of an appointment made by telephone or through personal contact with the clinic takes place on the date proposed by the clinic and accepted by the patient.

  3. A patient booking an appointment for the first time is required to:

    • a.    provide details such as name, telephone number or e-mail address;

    • b.    pay a prepayment (deposit) amounting to 100% of the price of the visit indicated at the appointment selection.

  4. The patient will receive the payment details for the first visit on the telephone number or e-mail address provided by the patient.

  5. he payment for the first visit must be made within a maximum of 24 hours of receipt of the transfer details, unless the visit is to take place before this deadline, in which case the payment for the visit must be made immediately and at the latest at the visit. Failure to pay by the deadline will result in automatic cancellation of the visit.

  6. The Patient shall make an appointment for each subsequent visit after the first visit by telephone, online or directly at the clinic and shall pay for the subsequent visit directly on the day of the visit before it takes place.

  7. Providing data by the Patient is considered a declaration that all data provided to the Service Recipient is true and that the Patient has full legal capacity or, in the case of its limitation, has the necessary consent of a legal guardian.


§ 3. Complaints

  1. The Patient has the right to submit complaints relating to the Service in person, by post or by e-mail to the Provider's e-mail address indicated in these Terms and Conditions.

  2. The time limit for handling complaints is a maximum of 14 working days counting from the date of receipt of the complaint.


§ 4. Cancellation or change of appointment

  1. Cancellation of both the first paid visit and any subsequent visit within a booked appointment is possible at the latest 24 hours prior to this date.

  2. cancellation of a paid appointment within the time limit specified in pt. 1 means that the patient has the right to have another appointment or to demand a refund of the prepaid visit fee.

  3. Cancellation of another appointment on the day of its planned visit means the obligation to pay for it, and in the case of purchasing a package by the patient, the amount due for the missed appointment is deducted from the purchased package.

  4. The patient is entitled to reschedule the first pre-paid appointment as well as the subsequent appointment three times. On the fourth attempt to postpone an appointment, the possibility to do so expires and the Patient - in the case of a pre-paid appointment - receives a refund of the funds transferred for the appointment in accordance with the rules set out in these regulations.

  5. Cancellation of a booked appointment can be done by sending an e-mail to the Service Provider's e-mail address provided in the Terms and Conditions or by contacting the registration by telephone, respecting the deadline specified in point 1 above. The Service Provider does not provide any other possibility of cancelling a booking.

  6. If the Patient is late for a booked appointment, the appointment shall be shortened by the time of the lateness, with the fee paid for the appointment remaining unchanged. If the Patient is late for more than half of the scheduled appointment time, the Service Provider is entitled to cancel the booked appointment, which results in the loss of the prepaid fee for the appointment. In this case, the appointment fee is non-refundable regardless of the reason for the lateness. In the case of patients who have purchased a package, the visit fee due as a result of the reasons mentioned above is deducted from the package.

  7. The service provider reserves the right to cancel a booked appointment at the latest one hour before the appointment. In the case of cancellation, the Service Provider will offer the Patient a new appointment time. If the new appointment is not accepted or not proposed, the Service Provider will refund the Patient the entire fee paid for the appointment.

  8. The Service Provider will refund the prepayment within 7 days of the cancellation of the booked appointment in accordance with the Terms and Conditions.


§ 5. Packages

  1. The Clinic offers the possibility of purchasing a package, but only after the first visit. Types, availability and prices are indicated on the Website and in the registration desk.

  2. Appointments included in the package are made in person or by telephone.

  3. Payment for the package is a one-off payment, at the latest on the first visit of the package.

  4. Payment for the package can be made in person or by bank transfer to the clinic's bank account.

  5. Refunds for unused visits from the package (within the validity period of the package) are possible. However, the amount for a single visit will be aligned to the regular price of the visit and the amount to be refunded will be reduced by this difference.

  6. The clinic does not take into account the possibility of more than one person using the package.

  7. he validity of the package is 3 months from the date of purchase of the package, after which time the package expires.

  8. With the expiry of the validity period, it is no longer possible to use the visits included in the package and the payment for the package will not be refunded.


§ 6. Refund of services

  1. In order to process a request for a refund, it is necessary to present the purchase receipt and to fill in an application form, which can be obtained at the clinic's registration desk.

  2. Refund will be made within 14 days from the date of filing the application.


§ 7. Closing remarks

  1. The Service Provider has the right to make changes to the Terms and Conditions.

  2. Any disputes between the Service Provider and the Patient will be resolved amicably.

  3. In the event of any dispute not being resolved amicably between the Service Provider and the Patient, the court of jurisdiction shall be the Court of local and material jurisdiction for the place of the Service Provider's registered office.

  4. In matters not covered by these Regulations, the provisions of universally applicable Polish law shall apply.

  5. These Regulations shall come into effect on 01.11.2023.
